The NSW Department of Planning and Environment’s Resources Regulator has announced it has started prosecution proceedings against Newcrest Mining Limited.

The court action is related to an alleged contravention of the Work Health and Safety Act 2011 that resulted in the death of a worker at the Ridgeway Mine, 20 kilometres south of Orange.

On 6 September 2015, an underground mine vehicle was pushed backwards after being struck by rock and material. The worker died after being crushed between the vehicle and the wall of the underground mine.

The Regulator will allege that Newcrest Mining Limited, the mine operator, failed to take all reasonably practical steps to provide workers with fit for purpose mining equipment and safe systems of work.

The Regulator has commenced Category 2 proceedings under section 19 and section 32 of the Act for failure to comply with a health and safety duty.

Category 2 Work Health and Safety offences attract a maximum penalty of $1,500,000.

The matter is set down for first mention in the District Court on 9 October 2017.
