Minerals and coal

Change to the grant and renewal process for licences and leases 

It is no longer a requirement for a licence or lease holder to sign and return the issued licence or lease document.

NSW Trade & Investment will supply a copy of the conditions and a payment request for any securities, rents or levies. Once these fees are paid the grant or renewal will be approved.

This is to reduce red tape and improve the processing time frames for applications. 

What is an authority?

Onshore exploration  and mining activities for minerals and coal in NSW must be conducted in accordance with an authority issued under the Mining Act 1992 (Mining Act).

Land access under the Mining Act

Environmental assessment

Depending on the conditions of your authority you may need to seek an activity approval via a Review of Environmental Factors.

All holders of mining leases proposing underground coal mining are required to submit subsidence management plans.

Survey and drafting directions

All surveys, plans and digital data submitted to the department for coal and metalliferous mines must follow the survey and drafting directions issued by the Surveyor General on the advice of the Board of Surveying and Spatial Information.

Current grants and applications

These reports, which are updated monthly, detail the type of title, the location and size of the title, as well as the applicant's name.

Land and Environment Court

Privately owned minerals

If you want to explore or mine privately owned minerals you must hold an appropriate title.

Uranium exploration

In 2012 the NSW Government passed legislation to remove the ban on the exploration of uranium to help gain an understanding of what resources may exist in the State. As yet no exploration activities have started.

Expressions of Interest (EOI) have been received from interested parties wishing to explore for uranium. These EOIs are currently being assessed and the successful parties will be invited to obtain Minister's Consent to apply for a Group 11 (Uranium and Thorium) Exploration Licence.
