Electricity and gas retailers operating in NSW have to be authorised. The Australian Energy Regulator External link icon issues authorisations under the National Energy Retail Law.

Some retailers also have statutory obligations such as providing regulated prices to customers, offering supply to customers in their districts and acting as a retailer of last resort.

The regulatory framework governing energy includes:

  • rules around marketing practices
  • an obligation of regulated offer retailers to supply small customers at regulated prices
  • minimum information requirements for electricity and gas bills
  • hardship policies developed by retailers and offering residential customers at least two payment plans before disconnection
  • price disclosure requirements
  • retailer of last resort protections.
