The National Energy Retail Law (Adoption) Regulation 2013 provides obligations for certain retailers to supply energy to customers at regulated prices and offer to supply to any customer in their respective districts.

Regulated offer retailers

Regulated offer gas retailers are obliged to offer customers in their allocated districts energy supply at regulated prices. Gas retailers who are not regulated offer retailers must notify customers of their right to enter into a regulated offer contract if they wish to do so.

The following retailers are the regulated offer retailers for gas:

  • ActewAGL, offering regulated prices to customers in the NSW/ACT border and Shoalhaven;
  • AGL, offering regulated prices to customers in the Greater Sydney region and inland NSW; and
  • Origin Energy supplying at regulated prices to the South Western regions of NSW and the NSW/Victorian border.

On 1 July 2014, the Government removed price regulation from the retail electricity market. Removing price regulation will promote greater competition in the electricity market and encourage more retailers to operate in NSW and offer better energy deals.

Local area retailers

Local area retailers are obliged to offer to supply energy in their associated distribution supply districts to customers who create new connections. This could be for example if a customer builds a new house and that house needs to be connected to the distribution network.

The following are local area retailers for electricity:

  • EnergyAustralia for customers in central Sydney, the Central Coast and Hunter region; and
  • Origin Energy (formerly Country Energy and Integral Energy) for customers in the South Coast, Illawarra, Western Sydney, the Blue Mountains, regional NSW and far western NSW.

The following are local area retailers for gas:

  • ActewAGL for customers in the NSW/ACT border and Shoalhaven;
  • AGL for customers in the Greater Sydney region and inland NSW; and
  • Origin Energy (formerly Country Energy and Integral Energy) for South Western regions of NSW and the NSW/Victorian border.

Retailer of Last Resort

Energy is an essential service. As a result, the Government has in place arrangements for customers in the event that an energy retailer is no longer able to supply to its customers. These arrangements are known as Retailer of Last Resort and enable customers to be automatically transferred and supplied by another retailer should such an event occur.

The following retailers have been appointed by the Australian Energy Regulator as default retailers of last resort for electricity customers in NSW:

  • ActewAGL for customers in the NSW/ACT border region;
  • EnergyAustralia for customers in central Sydney, the Central Coast and Hunter region; and
  • Origin Energy (formerly Country Energy and Integral Energy) for the remainder of NSW including the South Coast, Illawarra, Western Sydney, the Blue Mountains, regional NSW and far western NSW.

The following retailers have been appointed by the Australian Energy Regulator as default retailers of last resort for gas customers in NSW:

  • ActewAGL for customers in the NSW/ACT border region and Shoalhaven;
  • AGL in the Greater Sydney region and inland NSW; and
  • Origin Energy (formerly Country Energy and Integral Energy) for South Western regions of NSW and the NSW/Victorian border.
